For several days now, Senate Republicans have ridiculed their Democratic counterparts for prioritizing campaign finance legislation over a bill that would benefit small businesses, arguing that Majority Leader Harry Reid (D-Nev.) was putting electoral advantages over jobs for everyday people. On Tuesday, the DISCLOSE Act failed to get the needed votes for cloture, in the process providing the Senate the time needed to move on to other business. But when leadership brought a revised version of the small business bill to the floor on Thursday morning, they were met with united Republican opposition. Despite complaining about the delay in consideration, Republicans filibustered the measure by a vote of 58 (in favor of cloture) to 42 (against). GOP leadership argued that it wasn’t against the aims of the bill per se.

If President Obama fears Elizabeth Warren won’t be confirmed by the Senate to head the new Consumer Financial Protection Bureau, he should just appoint her while the Senate is on one of its many vacations, House Financial Services Chairman Barney Frank said Friday. Referring to her as “far and away the best candidate,” Frank said Warren, a noted consumer advocate and bailout watchdog who conceived the agency in a 2007 article, not only cares about protecting consumers but also has the political chops to get things done for them in Washington. “If [Warren] can’t be confirmed she should be a recess [appointment],” Frank, who helped shepherd the recently-enacted financial reform bill into law, told the Huffington Post on Friday. “Given the way [the Senate has] misused the filibuster… given it’s anti-Democratic, I think the President did exactly the right thing with Donald Berwick,” the 15-term Massachusetts Congressman added, referring to an earlier Obama recess appointment to head the Centers for Medicare & Medicare Services. Warren, a popular pick to lead the new consumer agency she envisioned, has seen her chances threatened by other candidates for the job. Treasury Secretary Timothy Geithner prefers Michael Barr, his assistant secretary for financial institutions and a veteran of the Clinton-era Treasury, according to people familiar with Geithner’s views. White House officials say the shortlist also includes Eugene Kimmelman, a former top official at consumer advocacy groups Consumers Union, the Consumer Federation of America and Public Citizen who now works in the Justice Department’s antitrust division.

Late last week, Congressional Democratic leadership settled on an alternative way of passing tough new campaign finance disclosure rules into law. With Sen. Scott Brown (R-Mass.) announcing his opposition to the DISCLOSE Act, negotiators would shift their focus to the two moderate Republicans from Maine. “I just talked to Senator Schumer within the last 30 minutes,” Rep. Chris Van Hollen (D-Md.), the sponsor of the House’s version of the legislation, told the Huffington Post Thursday evening. “He is going to continue to focus on identifying Republicans who support it. As you know Senator Snowe was very critical of the Supreme Court’s decision and the question that will be posed to her is, ‘Okay, what do you intend to do about it?’” On Monday, Snowe announced her intentions. In another blow to the bill’s chances, the Maine Republican said she thought the Senate should prioritize other pieces of legislation before the August recess.

PREVIOUSLY: NEW YORK (Associated Press) – Candidate for New York State Attorney General Eric Schneiderman has been involved in an apparent hit-and-run accident in Manhattan. That’s according to a NY1 report Tuesday that says the Democratic state senator was in a car driven by a staff member when it hit a parked car Monday night and drove away. NY1 says an eyewitness saw the incident and recorded Schneiderman’s license plate number.

NEW YORK — A federal appeals court on Tuesday tossed out a government policy that can lead to broadcasters being fined for allowing even a single curse word on live television, concluding that the rule was unconstitutionally vague and had a chilling effect on broadcasters. The 2nd U.S. Circuit Court of Appeals in Manhattan struck down the 2004 Federal Communications Commission policy, which said that profanity referring to sex or excrement is always indecent. “By prohibiting all `patently offensive’ references to sex, sexual organs and excretion without giving adequate guidance as to what `patently offensive’ means, the FCC effectively chills speech, because broadcasters have no way of knowing what the FCC will find offensive,” the appeals court wrote. “To place any discussion of these vast topics at the broadcaster’s peril has the effect of promoting wide self-censorship of valuable material which should be completely protected under the First Amendment,” it added. NEW YORK — The newest Supreme Court justice, Sonia Sotomayor (SOHN’-ya soh-toh-my-YOR’), is writing a memoir. Sotomayor is working with a collaborator on her life story, from her childhood in the South Bronx to her appointment to the court last year. Knopf Doubleday Publishing Group said Monday that the book is not yet titled and has no release date set. The book will come out simultaneously in English and in Spanish.

WASHINGTON — Justice Anthony Kennedy, who already decides whether liberals or conservatives win the Supreme Court’s most closely contested cases, is about to take on an even more influential behind-the-scenes role with the retirement of Justice John Paul Stevens. By virtue of seniority, Kennedy will inherit Stevens’ power to choose the author of some court opinions, an authority that has historically been used – including in as big a case as the landmark Roe v. Wade abortion decision – to subtly shape a ruling or preserve a tenuous majority. This change might keep the court’s most liberal justices from writing some of its biggest decisions. An unwritten high court rule gives the senior justice in the majority, most often the chief justice, the power to assign opinions.
